Nestd Terms & Conditions

1. About Nestd

Nestd ("Nestd", "we", "us", "our") runs an online platform that helps you compare removalists and request quotes for your move. We connect you with removalists in our network. We are not a removalist, and we do not carry out moves ourselves. The removalists are independent businesses.

2. Using Nestd

To use the Service you must be at least 18 and able to enter a binding agreement. You agree to give accurate, complete information and to use the Service lawfully.

3. Quotes Are Estimates

The quotes and prices shown through Nestd are estimates only, based on the details you provide. They are not fixed or binding. The removalist you choose confirms the final price, inclusions and terms before your move. We do not set removalists' prices, and the accuracy of an estimate depends on the accuracy of the information you give us.

4. Your Agreement Is With The Removalist

If you choose a removalist, the contract for your move is directly between you and that removalist, not Nestd. The removalist is solely responsible for the move, including its quality, timing, conduct, care of your belongings, and their own insurance and licensing. Any issue, claim or dispute about the move is between you and the removalist. Nestd is not a party to that contract and does not perform, supervise or guarantee the move itself.

5. Move-Day Guarantee

Where we offer a move-day guarantee, it means this: if the removalist you booked through Nestd is unable to carry out your move on the day, we will use reasonable efforts to find you another removalist from our network so your move can still go ahead. The guarantee does not promise a particular price, a particular removalist, a particular time, or a particular outcome, and it applies only on the terms we set out at the time of booking.

6. Your Responsibilities

You are responsible for the information you give us and for your dealings with removalists. You agree to:

• provide accurate, complete information;
• use the Service lawfully;
• make your own checks before booking a removalist; and
• deal directly with the removalist you choose for the move itself.

You consent to us sharing your details with the removalist you choose so they can quote and contact you. See our Privacy Policy.

7. Site Content And Accuracy

We take care with the Service, but we do not warrant that all content, including removalist listings, ratings, availability, inclusions and estimates, is complete, accurate or current, and content may change at any time. Reviews and opinions published on the Service are those of the people who wrote them, not Nestd, and we are not responsible for them. We recommend you make your own checks before you book a removalist.

8. Changes To The Service

We may change, suspend or withdraw any part of the Service at any time, with or without notice. We do not warrant that the Service will always be available or uninterrupted.

9. Content You Submit

If you submit content to the Service, for example a review, rating or feedback, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, publish and reproduce that content in connection with the Service. You confirm that the content is yours or that you have the right to share it, that it is accurate and not misleading, and that it is not unlawful or in breach of anyone's rights. We may edit or remove submitted content at our discretion.

10. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

• submit false or misleading information;
• scrape or harvest data from the Service;
• interfere with or disrupt the Service;
• attempt to gain unauthorised access to the Service; or
• use the Service for any unlawful or harmful purpose.

11. Intellectual Property

The Nestd name, logo, branding, design and the content we create on the Service are owned by us or our licensors. You may not copy, reproduce or use them without our written permission.

12. Third-Party Websites

The Service may link to removalists' websites or other third-party sites. We do not control those sites and are not responsible for their content, products, services, terms or privacy practices. If you visit them, their own terms apply.

13. Your Rights Under The Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If we are liable under a consumer guarantee that cannot be excluded, our liability is limited, where the law allows, to re-supplying the relevant service or paying the cost of having it re-supplied.

14. Limitation Of Liability

To the maximum extent permitted by law, and subject to clause 13:

• Nestd is not liable for any loss or damage, whether direct, indirect, incidental or consequential, arising from your use of the Service, from any removalist's acts or omissions, or from your move; and
• our total liability to you for any claim connected with the Service is limited to the amount, if any, you paid us for the Service. Because the Service is free to you, this will usually be nil.

This clause does not limit any liability that cannot be limited or excluded by law.

15. Indemnity

To the extent permitted by law, you agree to compensate us for any loss, damage or cost we suffer arising from your breach of these Terms or your misuse of the Service.

16. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.

17. Changes To These Terms

We may update these Terms from time to time. The current version is always on our website, with the Last updated date showing when it last changed. By continuing to use the Service after a change, you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of South Australia, Australia. You and Nestd submit to the non-exclusive jurisdiction of the courts of South Australia.
